Ecuador Gaming License
An Ecuador gaming license means one instrument: the Licencia para la Operación de Pronósticos Deportivos (LOPD), which covers online sports betting and nothing else. Ecuador is one of the few countries in the region with no legal physical casino, and it still licenses sports prediction. Online casino, poker and slots have no route. The LOPD runs up to five years at 655 unified basic salaries, USD 315,710 in 2026.
Is gambling legal in Ecuador?
Partly. An Ecuador gambling license exists for one vertical only. Ecuadorians voted on 7 May 2011 to prohibit businesses dedicated to games of chance, and land-based gambling closed. Online sports betting was carved out and became licensable from 2024. Everything else stays prohibited, with one statutory lottery exception.
The record, point by point:
7 May 2011. A popular consultation approved prohibiting businesses dedicated to games of chance, named in the question as casinos y salas de juego. Venues closed in the months that followed.
4 May 2026. The Procuraduría General del Estado issued Oficio 16528. The binding criterion holds that games of chance are an unlawful object in civil law, whether or not anyone profits from them.
No workaround survives it. Operating through a foundation or a non-profit does not take the activity outside the prohibition. Neither municipalities nor police intendencies may authorise a physical or online casino. The criterion also names the Fiscalía, the UAFE and the customs service as bodies that should examine the origin of funds in such venues.
One statutory exception. The lottery of the Junta de Beneficencia de Guayaquil is the only gambling operation expressly recognised in law.
Sports betting runs on its own track. Ecuador treats pronósticos deportivos as skill-based and distinct from games of chance. A licensing regime for it was created in December 2024 and fully regulated in June 2026.
The contrast is the whole of the Ecuadorian position. A prohibition confirmed by the state's own legal adviser in 2026 sits alongside a licensing regime that opened in the same year. The two apply to different products.
Who regulates gambling in Ecuador?
No gaming commission exists in Ecuador. A gambling license in Ecuador for sports betting comes from the ente rector del deporte, the national sports authority, exercised by the Viceministerio del Deporte. Three further bodies hold real authority over licensed operators: the tax authority, the financial intelligence unit and the state legal adviser.
The sports portfolio changed rank in 2025. Sources from 2024 and 2025 name a Ministerio del Deporte. After the reorganisation the function sits in a Viceministerio del Deporte attached to the education portfolio. Decreto Ejecutivo 422 avoids the naming problem by writing the licensing power to the ente rector del deporte. That is the term to work from.

Two of those bodies rarely appear in published guides. The UAFE became the operator's day-to-day AML counterparty only in April 2026. The Procuraduría is the body whose opinion decides how far the casino prohibition reaches. An operator that plans for the sports authority alone has planned for one of five.
What gambling license can you actually get in Ecuador?
One license, the Licencia para la Operación de Pronósticos Deportivos. Article 235 of Decreto Ejecutivo 422 makes it the sole título habilitante for offering sports betting and online prediction games inside Ecuador. Decreto Ejecutivo 445 of 10 July 2026 restated that. Residents and non-residents may both hold it.
The instrument was built in two stages. Decreto Ejecutivo 487 of 19 December 2024 created the LOPD and reformed the regulation to the Ley de Régimen Tributario Interno. The same decree gave the sports ministry three months to publish the process. That did not happen, and the sector spent 2025 taxed but unlicensed.
Decreto Ejecutivo 422 of June 2026 supplied the missing regulation. It arrived as the Reglamento General a la Ley Orgánica del Deporte, la Educación Física y la Recreación. The law itself entered into force on 11 February 2026.
What the LOPD does not give you matters as much as what it does:
No land-based betting shops or retail points.
No online casino, no live casino, no slots.
No poker, cash game or tournament.
No lottery, which is reserved to the Junta de Beneficencia de Guayaquil.
No access to any market outside Ecuador. The license is national and carries no passporting right.
How much does an Ecuador gaming license cost?
An Ecuador gaming license cost is fixed at 655 unified basic salaries for every year the license runs. Payment falls in the first 20 days of January. At the 2026 salary of USD 482 that is USD 315,710. At the 2025 salary of USD 470 it was USD 307,850. The charge is annual, not a one-off.
The fee falls due every year of the term, so a five-year license carries more than USD 1.57 million in state fees at 2026 rates. Most published figures still print USD 307,850, which was correct for 2025 and is wrong for 2026.
The mechanics decide what the number will be next January rather than this one. The fee is expressed in salarios básicos unificados, not in dollars. Ecuador set the 2026 salary at USD 482 by Acuerdo Ministerial MDT-2025-195 of 15 December 2025. The measure was published in Registro Oficial Supplement No. 187 and took effect on 1 January 2026. The 2025 figure was USD 470. Multiply either by 655 and the fee follows.
A national wage negotiation the operator has no part in therefore resets the license fee each January. The regulation also allows the finance ministry to revise the charge separately.
Late payment is not a billing matter. Failure to pay within the January window means the operator cannot continue trading, and it exposes the operator to sanctions, blocking and corrective measures.
Who can apply for an Ecuador sports betting license?
Any company whose corporate purpose admits sports prediction activity, resident or not. The 2026 regulation requires proof of legal existence, lawful representation and financial standing. The application is filed to the head of the sports authority. Non-residents are admitted but must appoint a local legal representative in Ecuador.
Appointing a representative is not the same as being resident. A non-resident company can hold the LOPD. The tax consequences of staying non-resident are severe rather than procedural, and the tax section below sets them out. What a non-resident cannot do is operate without someone in Ecuador who can be served and held answerable.
Registration with the Unidad de Análisis Financiero y Económico is mandatory. The operator must also run an AML risk-prevention system with an accredited compliance officer, under UAFE Resolution UAFE-DG-2026-0005 of 13 April 2026.
Financial standing is assessed by the authority rather than set as a published minimum capital figure. No threshold has been gazetted, so you cannot self-certify against a number.
One honest gap: the full documentary checklist sits in secondary rules that the sports authority has not yet published. Decreto Ejecutivo 422 requires them within 180 days of publication, which runs to December 2026. Any list of application documents circulating now is inference rather than published requirement, and we treat it that way.

How do you get a sports betting license in Ecuador?
Navigating the gaming license process can be complex. Here's a streamlined guide to each step.
Six workstreams, run mostly in parallel, not in sequence. The regulation sets no public review period, so no honest timeline can be quoted. Decreto Ejecutivo 422 was published in Registro Oficial Fifth Supplement No. 305 on 15 June 2026. Its transitional provision gives operators that were already active before the regulation took effect 90 days to file their authorisation request and evidence their tax compliance, which runs out around mid-September 2026. That deadline binds incumbents rather than new entrants: a new applicant files under the ordinary procedure whenever it is ready, and the regulator publishes no closing date for that.
One fact belongs in any Ecuador business case. No operator has been publicly confirmed as holding a fully issued LOPD as of September 2026. The regime is actionable rather than proven, and you would be joining a queue with no published precedent.
What taxes apply to licensed betting operators in Ecuador?
A 15% single income tax on the operator, a 15% withholding on player prizes and 15% IVA on the digital service. The rate is uniform. The operator's tax base is not: a resident pays on gross gaming revenue, a non-resident pays on the total amount wagered. Figures below are as of September 2026.

The residence split is the largest structuring decision here. Both pay 15%. A resident pays on what it keeps, a non-resident on everything staked. The regulation is written that way to pull operators onshore.
The player withholding base moved in 2026. It was the net positive balance across a calendar month. The 2026 regulation charges the prize won in each event predicted, which raises the burden.
SRI Circular NAC-DGECCGC26-00000004 of 31 March 2026 settled the IVA position. It treats sports prediction on digital platforms as a taxable digital service at 15%. The basis is articles 56 and 61 of the Ley de Régimen Tributario Interno, whose regulation lists betting among digital services at article 140.1. Three cases follow:
Non-resident platform, not registered in Ecuador. The bank or card issuer withholds 100% of the IVA at payment.
Resident platform, or a non-resident registered voluntarily. The resident invoices, and may issue one monthly invoice per user carrying the 15%.
Non-resident platform with no payment intermediary. The resident consumer becomes the taxpayer, issues a purchase settlement document and self-assesses 100% of the IVA.
For an offshore model the effects stack. The player carries a turnover-based income tax and the IVA. The impuesto a la salida de divisas then takes 5% of outbound funds.
What operational and advertising restrictions apply?
Hard transaction caps and specific advertising rules. Decreto Ejecutivo 422 limits what a player can move per transaction, per day and per month by payment channel. The same decree bans advertising aimed at minors, and makes influencers liable for promoting unlicensed operators. The caps are enacted, not proposed.

The monthly ceilings decide which player segments an Ecuadorian book can serve. A high-value player cannot be funded to a VIP level through any single channel, and the credit card route caps out first.
Advertising is permitted and conditioned. The 2023 blanket ban on betting advertising was lifted in October 2024. Article 252 of the 2026 regulation now sets the terms. No design may be directed at minors. No children or adolescents may take part in campaigns. No advertisement may create a false expectation of profit or present the activity confusingly. Every advertisement must identify the authorised operator and carry responsible gambling messaging.
The influencer rule is narrower than it is usually reported, and the difference favours the licensee. Content creators may not promote national or foreign operators that lack a license. A creator who does can be held jointly liable in the administrative process. A licensed operator may still run influencer campaigns. An unlicensed competitor cannot buy that channel at all, because the creator carries the exposure.
Are land-based casinos legal in Ecuador?
No. Land-based casinos and gaming halls have been prohibited since the popular consultation of 7 May 2011, and the prohibition stands. On 4 May 2026 the Procuraduría General del Estado issued Oficio 16528, answering a query from the Junta de Beneficencia de Guayaquil. Games of chance are an unlawful object in civil law, profit or no profit.
The query had a specific cause. Venues had opened in Guayaquil operating under a non-profit foundation structure, on the argument that the 2011 prohibition reached only commercial activity. The Procuraduría rejected that reading.
The criterion also disposes of the structures that had been tested against the ban. Operating through a foundation or a non-profit does not remove the activity from the prohibition. No exception exists beyond the one the law grants expressly to the Junta de Beneficencia de Guayaquil.
The Procuraduría further held that municipalities and police intendencies have no power to authorise a physical or online casino. The same criterion named three bodies to examine the origin of funds: the Fiscalía, the UAFE and the customs service.
Few countries in the region are in that position; Cuba, which banned gambling for money in 1959, is the other obvious one. No licensing authority for casinos has existed in Ecuador since the venues closed after the referendum.
Will Ecuador legalise casinos again?
Unresolved. A casino question was drafted, rejected by the Constitutional Court, redrafted, approved by the Court, and then never appeared on the ballot. As of September 2026 the prohibition stands, the question has not been put to voters, and no new date is confirmed. The chronology below gives each step with its date.

The ballot administered by the Consejo Nacional Electoral (CNE) carried four questions, and no casino question appeared on it. The accurate description is therefore approved for submission but not submitted. No official statement explains why the question was left off the ballot, and we do not speculate about it. Two conclusions do not follow from the record. The Court did not veto the reformulated question, and voters did not reject a casino question, because they were never given one.
For an operator, casino reopening is a live political subject rather than a pipeline. Nothing about it changes what can be licensed today.
Can you get an online casino or poker license in Ecuador?
No. Ecuador licenses sports predictions and nothing else. Online casino, poker and slots have no permitting regime, so there is no application to make and no authority with the power to grant one. The prohibition on games of chance covers them, and the 2026 legal criterion from the Procuraduría General del Estado explicitly reaches online casinos.
Two adjacent conclusions are false and worth stating plainly. That offshore sites remain reachable by Ecuadorian players does not make serving them lawful, and it creates no licensing route. Unlicensed operators face IP and site blocking.
Crypto is the second. Cryptocurrency is not legal tender in Ecuador, and article 98 of the Código Orgánico Monetario y Financiero bars unauthorised means of payment. The central bank places cryptoassets outside the authorised list. A crypto-funded model therefore has no compliant deposit rail. Buying and holding crypto is not prohibited; paying with it is.
The limit is structural rather than administrative. The licensing power in Decreto Ejecutivo 422 sits with the sports authority, and its mandate covers sport. Nobody has been given the power to authorise a game of chance. Creating one would require lifting the prohibition rather than issuing a regulation.
The search demand is real even though the product is not. Operators ask for an Ecuador online casino license because the phrase circulates, not because an instrument exists behind it.
If your product is casino or poker, the honest answer for Ecuador is no, and the sports betting license will not carry it.
Advantages of the Ecuador sports betting license
The case rests on access rather than on price. The LOPD is the only lawful route to Ecuadorian players, non-residents may hold it, and the dollarized economy removes settlement risk. The term runs up to five years with renewal, and operators were paying tax on this activity before any licence existed.
The only lawful channel. Every competitor serving Ecuador without the LOPD is exposed to blocking and to the turnover tax base. A license is the difference between operating and being tolerated.
Non-residents admitted. Foreign ownership is no barrier to holding the license, subject to appointing a local legal representative.
Dollarized settlement. The US dollar has been sole legal tender since 2000, so player balances, payouts and fees carry no local currency exposure.
15% on margin, if you structure for it. A resident licensee pays the single tax on gross gaming revenue rather than on turnover.
Influencer marketing stays open to licensees. The prohibition binds creators who promote unlicensed operators, so a licensed brand can use a channel its grey-market competitors cannot.
Operators were already here before the licence was. By late 2024 around 65 taxpayers were registered with the SRI for this activity, 19 companies and 46 individuals, with no licence regime in force.
The license is national. It gives access to Ecuador and to no other Latin American market, and any claim that it opens the region is wrong.
Disadvantages and risks of the Ecuador gaming license
USD 315,710 falls due every year, whatever the operator turns over. The charge sets a hard floor under viable scale and puts more than USD 1.57 million into a five-year plan. Around it sit a narrow product scope, an unfinished rulebook and real country risk.
A fixed cost indifferent to volume. The annual fee does not scale with revenue, so it prices small and mid-sized operators out rather than taxing them.
A fee set outside the sector. The charge is pegged to the national basic salary and moves whenever that is renegotiated. It rose from USD 307,850 to USD 315,710 in one January.
Narrow perimeter. Sports predictions only. There is no route to add casino, poker or slots later.
Built on decrees, not a dedicated statute. Three executive decrees and one law arrived in under two years. Lawyers have criticised precisely this: an instrument created by decree can be changed by decree.
An unfinished rulebook. Secondary rules on documents, certification standards and recognised laboratories are due within 180 days of publication and are not published. Parts of the process cannot be costed yet.
Transaction caps limit the top of the market. Monthly ceilings of USD 19,500 by transfer and USD 6,100 by credit card make a VIP proposition difficult to build.
Enforcement risk for anyone outside the license. Unlicensed operators face IP and site blocking, and their players carry a turnover-based tax plus IVA.
Country risk, improving from a low base. Ecuador has been under a declared internal armed conflict since January 2024. Sovereign risk did fall to an 11-year low in April 2026, under an IMF programme. Match fixing tied to illegal betting is an active integrity problem in domestic football.
No creator marketing before the licence is in hand. The prohibition binds influencers who promote unlicensed operators, and they carry joint liability, so affiliate and creator acquisition is closed until the LOPD issues.
No issued licence to point to. No operator has been publicly confirmed as holding a fully issued LOPD, so there is no precedent for how the authority will handle a file.
Political volatility around gambling. Casino reopening has been proposed, litigated and shelved inside eighteen months, and the subject has not closed.

The comparison sets up the real question, which is fit rather than price. Ecuador suits an operator that wants a sports book in a dollarized market and can absorb a fixed annual charge. An operator that needs casino alongside betting should look at Peru, Colombia or Brazil, where both verticals are licensable in one regime.
